HB 569
AN ACT relating to workers' compensation.
In Plain Language
This bill changes how workers' compensation cases handle illegal drug use. Right now, if a worker uses illegal drugs before getting hurt on the job, there's a legal assumption that the drugs caused the injury. This bill removes that assumption and instead requires evidence that the illegal drug use was actually the direct cause of the injury.
Official summary
Amend KRS 342.610 to remove the presumption that the use of an illegal substance prior to an accident caused the injury; provide that the use of an illegal substance shall be the proximate cause of the injury.
