HB 434
AN ACT relating to posthumous name changes.
In Plain Language
This bill allows a deceased person's family members to change the person's last name after death if the name came from a marriage to someone who was arrested for or charged with intentionally, knowingly, or recklessly causing that person's death. The priority for which family member can request the change follows the same order used in Kentucky's inheritance laws.
Official summary
Amend KRS 401.010 to allow a family member of a deceased person to posthumously change the deceased person's name if the name is the result of marriage to a person arrested for or charged with committing an offense intentionally, knowingly, or wantonly, which resulted in the death of the deceased; provide that the order of priority of family members is the same as in KRS 367.93117.
